1. Service operator

The website arkosinvestor.com (hereinafter, "Arkos Investor" or "the Platform") is operated by RE-ACT INVERSIONS 2000, S.L., with NIF B-67262865, a Spanish limited liability company.

2. Scope and acceptance

These terms govern access to and use of the Platform, which offers qualified investors information and investment opportunities in distressed real estate assets (NPLs, REOs, judicial-auction assignments, dations in payment) in Spain.

Use of the Platform implies full acceptance of these terms. If you do not agree, you must not register or use the service.

3. Registration and user account

To access registered features you must sign up with a valid email address and a password meeting the minimum requirements. You are responsible for the accuracy of the data provided and for safeguarding your credentials.

The Platform is intended for adults with legal capacity to enter into contracts. Accounts are personal and non-transferable.

Arkos Investor may suspend or cancel an account in case of fraudulent use, impersonation, breach of these terms, or behaviour contrary to applicable law.

4. Nature of the information

All asset information published on the Platform (indicative prices, valuations, discounts, estimated yields, photographs, descriptions) is informational and non-binding. It does not constitute a contractual offer or a guarantee of the asset's characteristics or financial outcome.

Photographs may correspond to the building or street view, not necessarily to the specific asset. The exact street address, cadastral reference, coordinates and full cadastral data are reserved for users who have signed the corresponding non-disclosure agreement (NDA).

Published prices may change after due diligence or adjustment by the asset holder. Any firm offer or reservation requires specific contractual documentation.

5. Sensitive information and NDA

Access to the exact street address, cadastral reference, full cadastral data or precise location requires the prior signing of a Non-Disclosure Agreement (NDA) in which the investor undertakes not to disclose such information or use it outside the scope of the contemplated investment.

A valid NDA records the signer's national ID (DNI/NIE), digitised handwritten signature, date and time, IP address and user-agent. These elements are required for the NDA to unlock access to sensitive information.

Breach of the confidentiality obligations may give rise to civil and criminal liability under applicable law.

6. Investment decisions

Arkos Investor does not provide financial, legal, tax or investment advice. The information available on the Platform is published for informational and commercial purposes and must not be construed as a personalised recommendation.

Investment decisions are the sole responsibility of the investor, who must conduct their own due diligence (legal, technical, urban-planning, tax, financial) or rely on independent professional advisers.

Past returns do not guarantee future results. Investing in distressed real estate carries specific risks (occupation, encumbrances, judicial delay, unrealised discounts) that the investor declares to be aware of and accept.

7. Intellectual and industrial property

The Arkos Investor brand, the arkosinvestor.com domain, all texts, images, code and other Platform elements are owned by RE-ACT INVERSIONS 2000, S.L. or its licensors. Their reproduction, distribution, public communication or transformation without express authorisation is prohibited.

Registration or use of the service does not grant the user any rights over those elements.

8. Limitation of liability

To the maximum extent permitted by law, Arkos Investor shall not be liable for indirect damages, lost profits, lost opportunity or investment decisions taken on the basis of the information published on the Platform.

The Platform is provided "as is" and, although reasonable measures are taken to maintain availability and data accuracy, the absence of interruptions, errors or temporary inaccuracies cannot be guaranteed.

9. Changes to the terms

These terms may be updated to reflect legal, operational or business-model changes. Substantial changes will be notified to registered users by email or by notice on the Platform with reasonable advance.

Continued use of the Platform after the entry into force of the changes implies acceptance of the new terms.

10. Governing law and jurisdiction

These terms are governed by Spanish law. For any dispute, the parties submit to the courts and tribunals of the user's domicile when acting as consumer or, when acting as professional, to those of the city of Barcelona, expressly waiving any other applicable jurisdiction.
